
Thanks for entering Lonely Planet’s 100 Million Guidebooks promotion. The following are the terms and conditions that you agree to when you enter the promotion.
Who’s running the show?
The promoter is Lonely Planet Publications Pty Limited (ABN 36 005 607 983) of 90 Maribyrnong Street, Footscray, Victoria 3011 Australia. Our friends at Nokia Corporation, Business ID: 0112038-9, Keilalahdentie 2-4, FI-02150 Espoo, Finland are our promotional partners. Information about the prizes and how to enter forms part of these conditions of entry. By entering the promotion, you agree that these conditions of entry apply to your entry and that Lonely Planet’s decisions (as the promoter) will be final. Any changes will be published on the Lonely Planet website at www.lonelyplanet.com/win.
Can I play?
The laws in some places don’t allow Lonely Planet to run this promotion, in which case the promotion and these conditions of entry are void in those places. Also, you can’t enter this promotion if you (or your immediate families or housemates) are employed by or work as an author for Lonely Planet, or are employed by Nokia Corporation or their subsidiaries and affiliated companies.
If you are under 18, you have to get permission from your parents or legal guardian to enter. Your parent or legal guardian will have to either accompany you or approve a responsible adult for you to take as your guest if you’re lucky enough to win the first prize!
The promotion is open to all photographers, professional or amateur. However, photographs that have won awards or competitions will not be eligible to win.
How do I play?
To enter you must submit your name, email address, and country of residence plus upload a photo that you have taken yourself of your travels, a description of the photo and the location in which the photo was taken via the promotional website at lonelyplanet.com/win. You don’t have to buy anything to enter. You can enter between 12:01pm AEST on 29th January 2010 and 12:01pm AEST on 28th July 2010. You can enter as many times as you like, however only one of your entries may be selected as a finalist (that means you will only be eligible to win one of the Nokia handsets in the prize description below). Your entry is received at the time Lonely Planet receives it. If your dog eats your entry, it’s not Lonely Planet’s fault. If your entry gets lost in cyberspace or doesn’t arrive for any other reason, that’s not Lonely Planet’s fault either.
Lonely Planet might have to change the dates of the promotion, but only if it’s totally unavoidable. Also, if there are compelling technical or administrative reasons which we cannot control, Lonely Planet can cancel or modify the promotion. If a modification means that some entries become ineligible, Lonely Planet may conduct the draw from all eligible entries received. If there are any modifications to the promotion Lonely Planet will update these terms and conditions with the relevant details.
Photos must be in jpeg format (jpg, jpeg, JPG or JPEG). Images should be at least 320x240 pixels and less than 6MB. All pictures must be cropped to be horizontal/landscape in orientation when you submit your entry, however your original image file will be the file viewed by the judges. Images should also be oriented correctly (ie. not turned sideways or upside down). You may submit as many photos as you wish, but each photo must be uploaded separately.
Images that have been digitally edited with software are accepted. You warrant that you are eligible to enter this promotion, your entry doesn’t infringe anyone’s copyright or privacy and your entry does not contain any virus, bug or technical defect that would corrupt or otherwise affect the security, integrity or operation of the promotional website or any other Lonely Planet websites or databases. You also warrant that your entry does not contain objectionable or offensive content. Lonely Planet reserves the right in its absolute discretion, to reject any entry including those which it deems to contain objectionable or offensive content.
A photo which displays an identified or identifiable person may infringe on that person’s right of privacy or may disclose that person’s personal information. Avoid submitting images which depict people in private or vulnerable situations and, where possible, try to get the permission of people featured in your image prior to submitting it.
Lonely Planet will upload and incorporate all images that are eligible for entry into the competition into a mosaic at lonelyplanet.com/win depicting a picture of the world or another picture selected by Lonely Planet approximately 1 week after receipt of your entry. If your entry is eligible and your photo is added to the mosaic, you will be sent by email a reference code to use at the promotional website to help you locate your photo in the mosaic. Lonely Planet will decide in its sole discretion which entries are incorporated in the mosaic. If an image is selected for inclusion in the mosaic this does not imply that it will be selected as a finalist or the grand prize winner.
Throughout the promotion various images may also be selected to be featured on the Lonely Planet homepage, in Lonely Planet emails, on the Lonely Planet Twitter account, on the Lonely Planet Facebook page and in image galleries on lonelyplanet.com. If an image is featured it does not imply that it will be selected as a finalist or a grand prize winner.
How do you pick the winner?
There are three levels of judging in this competition. The criteria at each level of judging are creativity, aesthetic appeal, originality and best representation of the pioneering and adventurous spirit of Lonely Planet.
A panel of at least 2 judges will review all eligible entries monthly throughout the promotion and decide on a pool of entries which best meet the above criteria. These judges will then submit their selection of entries to a second panel of at least 2 judges who will decide on a shortlist of 200 finalists. The second panel will make their decision between 29th July 2010 and 17th August 2010. Each finalist will win the finalist prize.
The 200 finalists will then be judged by a third panel of judges which will include Lonely Planet founders Tony and Maureen Wheeler. Based on all of the criteria listed above, the panel will select the grand prize winner from the 200 finalists. The judging of the finalists will happen between the 18th August 2010 and 25th August 2010.
For both the selection of finalists and the grand prize winner, the judges’ decision is final (so there!) and no correspondence will be entered into, even if you think that sucks. Lady luck has nothing to do with this promotion.
What can I win?
Grand Prize
The grand prize consists of round the world air tickets for two to the total value of AU$10,000 (including airfare, taxes and any other charges). The winner will liaise with Lonely Planet who will facilitate the round the world trip booking. The prize does not include accommodation, meals, insurance, transfers or any other costs associated with a round the world trip. If after booking the air tickets Lonely Planet determines that the total cost of the tickets is less than AU$10,000, Lonely Planet may give the difference to the winner as spending money. Total value of the grand prize is approximately AU$10,000.
Once the air tickets are booked, any amendments or cancellations to the booking will be at the winner’s cost and are the winner’s responsibility. Air tickets must be booked within 6 months of the grand prize winner being notified they have won. Air tickets are subject to availability, blackout dates, fare rules, restrictions and conditions.
Costs and organisation of valid passports, travel insurance and/or other necessary travel documentation and visas are not included and are the responsibility of the grand prize winner and their guest (including finding out what documents are necessary).
Finalist Prizes
200 finalists will each receive one of 200 Nokia handsets valued at up to AUD$800 each. The 200 handsets are a selection of Nokia’s N97 and N97 Mini models. If either of these models are not available in your country of residence and you are selected as a finalist, Nokia will provide a handset of Nokia’s choice.
The prize does not include costs associated with using the Nokia handsets, such as phone calls, telecommunications provider costs and data use etc. The handsets are provided as is without warranty or replacement. Nokia handsets may work in some regions and not others and may not be compatible with mobile phone networks in your region.
Total Prize Pool
The prizes have an approximate maximum value of AU$170,000. These prize values are accurate at the start of the promotion, and any change after the promotion begins is beyond our control.
How do I find out if I won?
The 200 finalists will be announced on 18th August 2010. We’ll give finalists the good news by email and their names and entries will be published on the promotional website within 1 week of selection.
The grand prize winner will be announced on 26th August 2010. We’ll give the winner the good news by email and their name will be published on the Lonely Planet website within 2 days after selection.
If you’re riddled with curiosity, send us a stamped, self‑addressed envelope (including the name of the promotion) within 3 months of the date of selection of the winner, and we’ll write back and tell you who won.
Lonely Planet will do its best to find the finalists and the grand prize winner. If we can’t find a finalist or if a selected finalist does not accept their prize by the 18th November 2010, we will select the next best entry as a finalist on the 25th of November 2010.
If we can’t find the grand prize winner or the grand prize winner does not accept their prize by the 26th November 2010 we will select the next best entry as the winner on the 8th December 2010.
Lonely Planet reserves the right to select an alternate finalist and an alternate winner if Lonely Planet determines in its sole discretion that a finalist or the grand prize winner does not adequately satisfy these terms and conditions.
If you do win...
You can’t exchange any of the prizes for cash, or ask us to give your prize to someone else (not that you’d want to!). If for some terrible reason Lonely Planet and our promotional partners cannot award a prize as described, the prize will be substituted either for cash or another prize of comparable value (but we’ll decide which).
You’ll be responsible for all taxes, insurance and any other expenses, fees and costs connected with the finalist prizes and grand prize that are not included in the prize descriptions above.
Before we can give you your prize, you’ll have to sign a “release”, which says that if anything goes wrong with your prize once it’s been awarded, you agree that Lonely Planet and its promotional partners won’t be responsible (unless the law says otherwise). If the prize description says you can take a friend, you’ll need to get your friend to sign a release too. The release will also include written confirmation from you that your photo has not previously won any award or competition.
Of course, if you win a prize, you’ll be good and comply with all relevant laws, rules and regulations.
What happens to my entry?
Once submitted, your entry will not be returned to you.
General licence: Unless you opt-out of this licence by un-ticking the box on the entry page, in return for entering the competition you grant Lonely Planet a worldwide, non-exclusive, irrevocable licence in perpetuity to reproduce, publish, adapt, communicate and broadcast all or part of your entry in any media for the purposes of this competition and inclusion in Lonely Planet branded products and marketing materials, including the right to sublicense.
Limited licence: If you do opt-out of the general licence by un-ticking the box on the entry page, in return for entering the competition you instead grant Lonely Planet a worldwide, non-exclusive, irrevocable licence for two years to reproduce, publish, adapt, communicate and broadcast all or part of your entry in any media for the purpose of this competition.
Please note: If you opt-out and you are later chosen as a finalist, upon your acceptance of the finalist prize and in return for that prize, you grant Lonely Planet the General Licence set out above.
We will use reasonable efforts to attribute you as the creator of your entry where possible, but you consent to us not attributing you if we decide not to. Despite any moral rights that may otherwise apply, you consent to us or our sub-licensees (in exercising any of the rights granted by you above) using, reproducing, editing, publishing or communicating your entry in any form or medium.
Lonely Planet and its promotional partners will only use the personal information contained in your entry to conduct the promotion, create the mosaic and award the prize. We may also contact you if we wish to use your image in a way that requires permission from you beyond the permissions you have granted in the licence(s) above. If you’ve told Lonely Planet that you want to receive stuff from us and/or our promotional partners, we’ll use your personal information for that too. If you win a prize, Lonely Planet can use your name to credit you for your entry and for marketing purposes unless you tell us not to.
